Terms of Service – Alekhyam by Kalaras

OVERVIEW

Welcome to Alekhyam by Kalaras. The terms “we”, “us”, and “our” refer to Alekhyam by Kalaras (Kalaras Art Innovations (OPC) Private Limited). We operate this website and store, including all related information, content, features, tools, products, and services (the “Services”).

These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services. Please read them carefully as they include important information about your legal rights and contain warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy (see link below). If you do not agree, do not use the Services.

1. ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state/UT of residence, and you consent to allow any of your minor dependents to use the Services on devices you own or manage.

To browse or purchase, you may be asked for information such as your email, billing, payment, and shipping details. You warrant that all information you provide is accurate, current, and complete, and that you have the rights necessary to provide it.

You are responsible for safeguarding your account credentials and for all activity under your account. You may not transfer or license your account to any other person.

2. OUR PRODUCTS

We aim to present products accurately. However, colours and appearances may vary due to device settings. Many of our sketchbooks are handcrafted; minor variations in trim, grain, or texture are normal and not defects.

We do not warrant that the appearance or quality will meet your expectations. Product descriptions may change at any time without notice. We may discontinue products or limit quantities to any person, region, or jurisdiction at our discretion.

3. ORDERS

When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted only when we confirm acceptance and process your payment. Please review your order before submitting; we may be unable to cancel once accepted. If we decline or modify an order, we will attempt to notify you via the contact details provided at checkout.

Returns and exchanges are governed solely by our Refund Policy (link below). You represent that your purchases are for personal or household use and not for commercial resale or export.

4. PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the one in effect at the time of order and appears in your order confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, or import charges.

We may run promotions governed by separate terms; if there is a conflict, those terms prevail. You agree to provide accurate purchase and payment information and to keep it updated (including card numbers and expiry dates).

You represent that: (i) your payment information is true and complete; (ii) you are authorised to use the payment method; (iii) charges will be honoured by your provider; and (iv) you will pay all charges at posted prices, including shipping and applicable taxes (e.g., GST).

5. SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we hand over products to the carrier.

6. INTELLECTUAL PROPERTY

All content on the Services—including trademarks, brands, text, images, graphics, video, and audio, and their design and arrangement—is owned by Alekhyam by Kalaras, its affiliates, or licensors, and is protected by Indian and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without our prior written consent. “Alekhyam,” related logos, product names, designs, and slogans are trademarks of Alekhyam by Kalaras. Other names and logos are trademarks of their respective owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use of such tools is at your own risk and subject to the third party’s terms.

8. THIRD-PARTY LINKS

The Services may contain links to third-party websites or materials. We are not responsible for examining or evaluating their content or accuracy and are not liable for any harm or damages arising from your use of them. Review third-party policies before engaging in transactions with them.

9. PRIVACY

Personal information collected through the Services is subject to our Privacy Policy. We may share your information with service providers—such as payment processors (e.g., Razorpay), fraud-prevention vendors, analytics providers, fulfilment and logistics partners, customer support tools, and IT/security providers—to operate and improve the Services and to fulfil your orders. 10. FEEDBACK

If you submit reviews, ideas, or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent that you have the necessary rights to grant this licence and that your Feedback complies with these Terms and applicable law. We may monitor, edit, or remove Feedback at our discretion.

11. ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain typographical errors or inaccuracies (e.g., in descriptions, pricing, promotions, shipping charges, transit times, or availability). We may correct or update information or cancel orders if information is inaccurate at any time, without notice.

12. PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to, directly or indirectly: (a) violate any law; (b) infringe intellectual property rights; (c) harass, defame, or harm others; (d) transmit false or misleading information; (e) upload or transmit malware; (f) send spam or unsolicited messages; (g) impersonate others; (h) scrape or crawl the Services; or (i) interfere with or circumvent security features. We may terminate or suspend your access to the Services at any time, in our sole discretion. You remain liable for amounts due up to the termination date. Sections intended to survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will continue to apply.

14. DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers; in such cases, they apply to the maximum extent permitted by law.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Alekhyam by Kalaras and our directors, officers, employees, affiliates, agents, contractors, service providers, and licensors shall not be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Services or any product, even if advised of the possibility of such damages. Our aggregate liability to you for all claims shall not exceed the amount you paid to us for the product(s) giving rise to the claim in the 3 months preceding the event.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Alekhyam by Kalaras and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or violation of law or third-party rights.

17. SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remainder will remain in full force.

18. WAIVER; ENTIRE AGREEMENT

Failure to enforce any provision is not a waiver. These Terms, along with policies posted on the website (including the Privacy and Refund Policies), constitute the entire agreement between you and us and supersede prior agreements regarding the Services.

19. ASSIGNMENT

You may not assign or transfer your rights or obligations without our prior written consent. We may assign or delegate these Terms and our rights and obligations without notice.

20. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. You and Alekhyam by Kalaras agree to the exclusive jurisdiction of the courts at New Delhi, India.

21. HEADINGS

Headings are for convenience only and do not affect interpretation.

22. CHANGES TO TERMS

We may update these Terms by posting a revised version on this page. Material changes will be notified as required by law. Your continued use of the Services after the effective date constitutes acceptance.
